TERMS AND CONDITIONS

By purchasing this item from Proastroz Pty Limited (also referred as ProAstroz) you, the buyer (customer), explicitly accept the following Terms and Conditions. If you do not agree to these Terms and Conditions, in whole or in part, please do not use this listing and do not purchase the item listed for sale. All rights not expressly granted in these Terms and Conditions are reserved.
The product you purchase is designed and meant to be used for the following purpose ONLY: observation & photography of stars, planets and other celestial objects at night. Any other use is deemed improper use.
 

FREIGHT & INSURANCE

- Freight Insurance is not included by default when placing orders - it is an optional service which customers can select at checkout by clicking the “secure your shipment” banner. We strongly suggest that customers add freight insurance when placing orders to fully insure all items against damage and loss in transit. We are not responsible for loss of parcels or damage sustained by parcels as the carrier is responsible. All the items are packed with plenty of protective materials and labelled properly.
- Uninsured items which get damaged or lost in transit will not be repaired or substituted free of charge. Customers will be required to follow up lost-item retrieval with the transport service that lost the item. 
- Freight Insurance is 2% of the total value of the purchased goods. This fee protects buyers against possible product damage or loss in transit, however damage caused by 'acts of god' as they are known are not covered by (any) insurance.
- In stocks items are dispatched within 2 business days of finalised payment, tracking is provided at the time of dispatch.
- Items that are sold while not in stock are dispatched within 2 business days of reception by ProAstroz Pty Limited. 
- International orders with delivery address outside of Australia: the buyer is responsible for any import duty, fees or other taxes upon arrival. ProAstroz is unable to advise whether a customs duty, fee or tax will be collected upon arrival in the country of destination, as this varies greatly by country and depends on a range of factor. It is the buyer's responsibility to ensure research has been done, prior to purchase, into what fees (if any) will be levied upon arrival. By ordering through the website, the buyer accepts the sole responsibility for any such payment. ProAstroz deducts the cost of GST to any purchase which delivery address is outside of Australia. In the event a package is returned to ProAstroz, a refund will be provided for the cost of the items purchased - please note this does not include the shipping and insurance cost: if a package is returned to ProAstroz, no refund will be provided for the cost of freight and insurance. 
 

LIMITATION ON LIABILITY 

ProAstroz Pty Limited, its director(s), beneficial owner(s), shareholder(s), or any other entity related to the business in any way is not liable for any personal injury whether to the buyer or any other party, damage to property, indirect, direct, punitive, special, incidental, consequential or exemplary damages. Proastroz Pty Limited is not liable for any damages whatsoever regardless of any previously advised possibility of such damages, whether in action under negligence, contract or any other theory, arising out of any connection or use, or the inability of use/performance of the services, information, products and materials that are available from this website. In particular, it is the buyer's responsibility to ensure all products are used correctly and never by children or anyone under 18 years of age or the age of maturity (majority) in the legislation the user resides or operates the equipment purchased from Proastroz Pty Limited. All customers should note the following: NEVER LOOK OR POINT AT THE SUN UNDER ANY CIRCUMSTANCES: any form of personal injury or any kind of damage resulting from this action, whether voluntarily or not, will be the sole responsibility of the buyer (customer) and under no circumstances can Proastroz Pty Limited, its director(s), beneficial owner(s), shareholder(s), or any other entity related to the business in any way can be held accountable, in any possible way, financial or otherwise.  It is the buyer's (customer) responsibility to ensure any items purchased from Proastroz Pty Limited are not left unattended while in use and are securely packed away after use, with all optical surfaces covered by an appropriate solid cover to prevent exposition to sun light and risks of shattering, and with the item itself packed in a storage box and left out of reach of children. Proastroz Pty Limited, its director(s), beneficial owner(s), shareholder(s), or any other entity related to the business in any way cannot be held liable for any personal injury or damage resulting from looking at the sun or utilising any of the products offered for sale on this website to point or look at the sun.
Furthermore, it is the sole responsibility of the buyer (customer) to carefully and thoroughly inspect all glass & optical surfaces before each and every use of an item containing glass such as a telescope, eyepiece, filter, binoviewer, diagonal etc. to ensure all surfaces are clean, undamaged, securely mounted to its attaching structure and free from any foreign objects that could interfere with the human eye, and especially shards of broken glass  and under no circumstances can Proastroz Pty Limited, its director(s), beneficial owner(s), shareholder(s), or any other entity related to the business in any way can be held accountable, in any possible way, financial or otherwise for any personal injury whether to the buyer or any other party. If a damage to a glass or optical surface is observed, the item should be securely isolated, away from children, pets and individuals. 
To the maximum extent permitted by relevant law, Proastroz Pty Limited, its director(s), beneficial owner(s), shareholder(s), or any other entity related to the business in any way total liability to the customer (buyer) for any damages shall not exceed in the aggregate, the total fees paid by the customer (buyer) during the 30 days immediately preceding the act allegedly resulting in any liability directed to Proastroz Pty Limited.     
 

RETURNS, EXCHANGES & REFUND POLICY 

Please choose products carefully as we do not accept returns for change of mind.

We get it, we’ve all made mistakes; return requests for incorrect items that have been delivered must be made within 14 days from the date of delivery and a store credit will be provided in the original amount (including any discounts). Eligible returns must be in the same unopened condition you received the item in with all original packaging. The corresponding order number must be supplied to enquire about returns and exchanges with us.

The cost of return shipping is covered by ProAstroz Pty Limited in the case of warranty-related issues, in all other cases shipping is due to the customer.

Damaged or faulty products: Any claims for damaged or faulty goods must be reported within 30 working days from reception (signature to the Post courier) of the item. Occasionally, and despite our best efforts to ensure the quality of all the products we supply, the product you receive may not work properly or could have a missing part. In the unlikely event this happens, please contact us. We will pay for the postage of the faulty item back to us for repair or replacement or will supply replacement/missing parts. If the item cannot be repaired a new replacement will be sent when possible or a full refund will be given. All returns will need to be accompanied by documentation and a valid RMA number in order to be processed (please contact us to obtain this reference). We reserve the right to refuse unauthorised returns. It is the buyer's (customer) responsibility to ensure the returned goods are delivered safely. We take no responsibility for goods lost in transit. We recommend you use a registered posting service that requires signature on delivery when returning goods to us. Returned goods must be shipped undamaged (where applicable) in their original, undamaged (where applicable) packaging.  Refunds are issued via the same channel as the original purchase: for instance if purchase was made through Paypal, the refund will be issued through Paypal to the same account we received the funds from.
 

WARRANTY POLICY

All our products come backed with a 2 years, no fuss, warranty. 
For your complete peace of mind, each item is covered by an Australian 2 year warranty against manufacturing defects and workmanship. We will repair or replace any item presenting an issue of a defective nature. Simply contact us with the date of your purchase. Please note the warranty does not cover misuse or user errors as well as normal wear and tear. If you detect an issue with your item upon delivery, please contact us within 7 days of reception. Warranty terms and conditions
We warrant your product to be free from defects in materials and workmanship for two years. This warranty is only valid for purchasers located in Australia. We will repair or replace such product or part thereof which, upon inspection by us, is found to be defective in materials or workmanship. As a condition to the obligation of Proastroz to repair or replace such product, the product must be returned to us together with the date of your purchase, full name and address. All returns must be accompanied by a written statement setting forth the name, address, and daytime telephone number of the owner, together with a brief description of any claimed defects. Parts or product for which replacement is made shall become the property of Proastroz. The customer (you) shall be responsible for all costs of transportation and insurance to ship the item back to us, but we will cover the return shipping to you. Proastroz shall use reasonable efforts to repair or replace any product covered by this warranty within thirty days of receipt. This warranty shall be void and of no force of effect in the event a covered product has been modified in design or function, or subjected to abuse, misuse, mishandling or unauthorised repair. Further, product malfunction or deterioration due to normal wear is not covered by this warranty. Specifically, the warranty does not cover user errors - such as dropping the telescope, scratching the frontal corrector plate, leaving the telescope in the rain, over or under tightening some screws etc., not using the telescope for its intended purpose - such as disassembling the telescope, using the telescope in an unsuitable environment (corrosion, excessive humidity etc.) etc., and it also does not include normal wear and tear such as marks in the dovetail from the mount locking screws, marks in the body of the eyepieces or diagonals from locking screws, oil marks on the lens of eyepieces from observing, the rubber guard of the eyepiece etc. This list is not exhaustive. Simply put, things that will alter through normal use over the life of the telescope or item are not covered under warranty. ProAstroz Pty Limited, its director(s), beneficial owner(s), shareholder(s), or any other entity related to the business in any way DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, WHETHER OF MERCHANTABILITY OF FITNESS FOR A PARTICULAR USE, EXCEPT AS EXPRESSLY SET FORTH HEREIN. THE SOLE OBLIGATION OF PROASTROZ PTY LIMITED UNDER THIS LIMITED WARRANTY SHALL BE TO REPAIR OR REPLACE THE COVERED PRODUCT, IN ACCORDANCE WITH THE TERMS SET FORTH HEREIN. PROASTROZ PTY LIMITED EXPRESSLY DISCLAIMS ANY LOST PROFITS, GENERAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHICH MAY RESULT FROM BREACH OF ANY WARRANTY, OR ARISING OUT OF THE USE OR INABILITY TO USE ANY OF PROASTROZ PTY LIMITED'S PRODUCTS. ANY WARRANTIES WHICH ARE IMPLIED AND WHICH CANNOT BE DISCLAIMED SHALL BE LIMITED IN DURATION TO A TERM OF TWO YEARS FROM THE DATE OF ORIGINAL RETAIL PURCHASE.
